A BILL to amend article three-a, chapter sixty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section three-a; and
to amend article seven of said chapter by adding thereto a new
section, designated section nine, all relating to requiring
employees of licensed private clubs and retail outlets selling
alcoholic beverages to take the techniques for education and
alcohol management (TEAM) course or other similar alcohol
awareness education course provided or approved by the alcohol
beverage control commissioner.
Be it enacted by the Legislature of West Virginia:

That article three-a, chapter sixty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
three-a; and that article seven of said chapter be amended by
adding thereto a new section, designated section nine, all to read
as follows:
ARTICLE 3A. SALES BY RETAIL LIQUOR LICENSEES.
§60-3A-3a. Mandatory TEAM training for retail outlet employees.
Any employee of a retail outlet licensed pursuant to the
provisions of this article who is hired on or after the first day
of July, two thousand one, shall participate in the Techniques for
Education and Alcohol Management program (TEAM), or other similar
alcohol awareness education program provided or approved by the
commissioner, within sixty days of commencing employment and every
three years thereafter. Any employee whose employment commences
prior to the first day of July, two thousand one, shall participate
in the TEAM program or other similar program provided or approved
by the commissioner before the first day of July, two thousand two,
and every three years thereafter. The commissioner shall propose
rules for legislative approval in accordance with the provisions of
article three, chapter twenty-nine-a of this code to implement the
provisions of this section.
ARTICLE 7. LICENSES TO PRIVATE CLUBS.

Any employee of a private club licensed pursuant to the
provisions of this article who is hired on or after the first day

Education and Alcohol Management program (TEAM), or other similar
alcohol awareness education program provided or approved by the
commissioner, within sixty days of commencing employment and every
three years thereafter. Any employee whose employment commences

in the TEAM program or other similar program provided or approved
by the commissioner before the first day of July, two thousand two,
and every three years thereafter. The commissioner shall propose

NOTE: The purpose of this bill is to require all employees of
licensed private clubs and retail outlets selling alcoholic
beverages to take the Techniques for Education and Alcohol
Management (TEAM) course provided by the Alcoholic Beverage
Commission.
